ASSUMPTION OF RISK
I acknowledge that participation in golf simulator activities, including but not limited to swinging golf clubs, using electronic equipment, and engaging in related games and activities, involves inherent risks. These risks include, but are not limited to: injury from golf club swings, impact from golf balls, trips and falls, equipment malfunction, muscle strains, and other physical injuries. I voluntarily assume all risks associated with my participation.
RELEASE OF LIABILITY
In consideration of being permitted to participate in golf simulator activities provided by GJ Golf Party LLC ("Company"), I hereby release, waive, discharge, and covenant not to sue the Company, its owners, operators, employees, agents, and representatives from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or to any property belonging to me, while participating in such activities, regardless of whether such loss is caused by the negligence of the Company or otherwise.
INDEMNIFICATION
I agree to indemnify and hold harmless the Company from any loss, liability, damage, or costs, including court costs and attorney fees, that may incur due to my participation in said activities, whether caused by negligence of the Company or otherwise.
MEDICAL ACKNOWLEDGMENT
I certify that I am physically fit and have no medical condition that would prevent my full participation in golf simulator activities. I understand that the Company does not provide medical insurance for participants and that I am responsible for my own medical coverage.
EQUIPMENT RESPONSIBILITY
I agree to use all equipment properly and as instructed. I accept financial responsibility for any damage to equipment caused by my intentional misuse, recklessness, or failure to follow instructions provided by Company staff. Normal wear and tear during proper use is excluded from this provision.
PHOTO/VIDEO RELEASE
I grant the Company permission to use any photographs, videos, or recordings taken during my participation for promotional, marketing, and social media purposes without compensation. I understand I may opt out of this provision by notifying Company staff before the event begins.
MINORS
If the participant is under 18 years of age, the parent or legal guardian must sign this waiver on their behalf. By signing, the parent/guardian acknowledges that they have read and understood this waiver and agree to its terms on behalf of the minor participant.
GOVERNING LAW
This waiver shall be governed by and construed in accordance with the laws of the State of Colorado. Any disputes arising from this waiver shall be resolved in the courts of Mesa County, Colorado.
ACKNOWLEDGMENT
I have read this waiver and release of liability, fully understand its terms, and understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing this agreement freely and voluntarily, and intend by my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.
